Starr, who is now dean of the law school at Pepperdine University in Malibu, California, urged the high court in his appeal brief to clear up the "doctrinal fog infecting student speech jurisprudence."
According to an Associated Press report, Starr is handling the case free of charge.

Isn't it wonderful to see that Kenny Starr is still doing legal work that's important to the nation? Maybe next he can represent Florida's Dixie County when they are sued by the National Correct Spelling League for their Ten Commandments stones?

From seattlepi.com come some choice tidbits:The school board upheld the suspension, and a federal judge initially dismissed Frederick's lawsuit. The 9th Circuit U.S. Court of Appeals said the banner was vague and nonsensical and Frederick's civil rights had been violated. Bolding mine. Isn't it great when your civil rights can be violated when you say nonsense? I'm actually serious, not sarcastic.
Also, CNN and seatllepi.com seem to be in disagreement. CNN:Principal Deborah Morse ordered the 18-year-old senior to take down the sign, but he refused. That led to a 10-day suspension for violating a school policy by promoting illegal drug use. seatllepi.com:Frederick said his motivation for unfurling the banner, at least 14 feet long, was simple: He wanted it seen on television since the torch relay event was being covered by local stations. When Morse saw it, she crossed the street from the school, grabbed the banner and crumpled it. She later suspended Frederick for 10 days. Interesting difference there. |
