Look, technically, any lawsuit demanding an organ from someone else would be required to show a pressing need for said property. And if the government agrees that "well, you've got two of them" is good enough, then that would already be good enough for homes, cars, PlayStations and everything else which isn't nearly as personal as an organ. The courts, so far as I know, have never concured with such an argument, which is why we still have homeless people.
Plus, eminent domain - the practice whereby the government can sieze property and put it to other uses - requires just compensation. If the government were to use an eminent domain argument to take someone's kidney and give it to another person, they'd be forced to pay or otherwise compensate the donor, which would violate several national and international laws against trafficking in human body parts. |
