Matt,
If you are saying that the very fact that I considered whether or not the soup can was art makes it art regardless of the conclusion I came to, then I challenge you to present an example of something, anything at all, which is not art.
Oh poop. I knew you'd say this. OK, again, I appeal to the fact that art is a social activity. Sure you can decide to look at your coffee mug in the morning and consider "Do I have an artistic response to this or not?" But that's random. When you see something hanging on the wall in a gallery, cultural indicators are specifically telling you to recognize it as art, and that is why you would typical respond by looking at it and considering "Do I have an artistic response to this or not?"
Here is another way I can explain why I take issue with defining art as just “A creative work which evokes an aesthetic, emotional or intellectual response.” Artists who work representationally usually choose a subject because they have had an aesthetic, emotional or intellectual response to it. Then they try to bring that recognition to an audience by transforming the subject matter visually. For instance, Georgia O'Keeffe said she painted flowers very large and with rich colors so people would see them as she saw them. Warhol was apparently inspired by looking at rows of Campbell soup cans on shelves in the grocery store. Now the flowers aren't a “creative work” unless there is a conscious deity who made them. But the soup can could be said to be a creative work because they were indeed designed by commercial artists. So are the actual soup cans art?
