Jo Hovind's attorney, Jerry Barringer, said after the sentencing that he plans to file an appeal against the guilty verdict as well as the prison sentence.

Don't those two normally coincide? Or am I missing something here?

Why continue? Because we must. Because we have the call. Because it is nobler to fight for rationality without winning than to give up in the face of continued defeats. Because whatever true progress humanity makes is through the rationality of the occasional individual and because any one individual we may win for the cause may do more for humanity than a hundred thousand who hug their superstitions to their breast.

If you appeal the verdict, then yes, you're generally suggesting that the sentence should be no time at all. But in case that appeal fails, you can appeal just the sentence as being to harsh or otherwise badly ruled.
